Q1. Is trademark registration mandatory in India?
No, it's voluntary. But without registration, you can only rely on the common-law remedy of “passing off,” which requires proving prior use and goodwill — a much harder legal battle than infringement under a registered mark.
Q2. What's the difference between ™ and ®?
™ can be used as soon as you file your application, signalling a claimed but not yet registered mark. ® can only be used after you actually receive the registration certificate.
